Well, those people are right... but while the movie is flawed by the kiss, it's still an accurate adaptation of how the comics were back then, so the writers understood what they were doing.
They saw comics with powers that came and went without explanation so they used that because that's what the source material was like.
Just look at Burton's Batman. That's based on the source material of the time, while Batman & Robin is based on source material from 20 years earlier, which is why it sucked.
