Because Liefeld significantly redesigned the Joe Simon/Jack Kirby character to more closely resemble Captain America and reused much of his Captain America material from "Heroes Reborn"--material he created during his stay at Marvel. Even the initial "Agent: America" designs Liefeld was developing prior to buying the Fighting American rights were a clear-cut visual copy of Captain America.
Supreme, by contrast, has no visual similarity to Superman. You stand them side by side, and you can tell them apart easily. Not so with Captain America and Liefeld's Fighting American, hence the lawsuit.
